About this form

ABOUT THIS FORM

Use this form to apply for approval to construct, reconstruct, or remove a driveway.

Note: If the proposed works are on a classified road then concurrence of the Transport for NSW (TfNSW) will be required.

APPLICATION PROCESS

RESIDENTIAL DRIVEWAYS

The Application process is as follows:

  1. Once your application is lodged, a Council Officer will review
  2. A site inspection will take place within 7 business days
  3. If further information is required, a Council Officer will contact you within 12 business days from lodgement of your application
  4. If no further information is requested by the Council Officer, You will receive your approval to construct within 12 business days from lodgement of your application
  5. Please notify Council once works are complete. Contact Councils Customer Experience Team on 4988 0255 to organise a final inspection 

COMMERCIAL / INDUSTRIAL DRIVEWAYS

The Application process is as follows:

  1. Once your application is lodged, a Council Officer will review
  2. A site inspection will take place
  3. If no further information is requested by the Council Officer
  4. You will receive your approval to construct within 21 days
  5. Please notify Council once works are complete/prior to construction, as outlined in your approval

FEES AND CHARGES

Driveway Applications incur a charge in accordance with the Port Stephens Schedule of Fees and Charges (in place as of the date that payment falls due). The fees for the 2023/2024 financial year are as follows:

  • RESIDENTIAL DRIVEWAYS: $280.00 per driveway crossing. Upon completion of this form, you will be asked to provide payment to complete the submission of your request.
  • INDUSTRIAL/COMMERCIAL DRIVEWAYS: The fee is calculated at 4% cost of works, however, this will be reviewed on lodgement and an invoice will be issued for payment. 

PRIVACY

Port Stephens Council is committed to protecting your privacy. We take reasonable steps to comply with relevant legislation and Council policy.

Purpose: Council collects the information to ensure owner's consent is given and that the proposed works are appropriate and fit for purpose.

Intended recipients: Council assessing Officers and its approved contractors will use the provided information to assess the proposed works.

Supply: This is legally required information for this application.

Consequence of Non Provision: The Application may not be assessed.

Storage and security: This document will be placed on the relevant file and/or saved in Council’s records management system in accordance with Council policy and relevant legislation.
