Council clarifies policy - Media Release

At last night’s Ordinary meeting, Port Stephens Council considered a possible new policy for development in the Rural 1(a) Zone.

In doing so, it moved to ensure land owners maintained their ability to apply for dual occupancy status.
 
The decision comes after a recent State Government Planning Policy placing strong obligations on Councils to bring higher standards to managing rural development.

Council considered the issue of dual occupancy development in rural areas as part of its revision of the Port Stephens Local Environmental Plan. 

The current Plan enables Council to give approval for second dwellings on rural properties if:

a) The property is greater than 4,000 square metres in area
b) If the two dwellings give the appearance of being combined by sharing access, bushfire management and satisfying other criteria.
 
At its meeting, Council decided to take no action to change the current policy.

As such, rural land owners that meet the appropriate criteria have been assured that the ability to apply for Council approval for dual occupancy on rural land is maintained.
